Terms of Service

By accessing and using the Qiyam mobile application ("the App") or visiting our website at qiyamapp.com ("the Website"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not access or use our App or Website.

Age Requirements

You must be at least 13 years old to create an account and use the App. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18 years old (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Binding Agreement

These Terms constitute a legally binding agreement between you and Amine Benlaroui ("we," "us," or "our"). By using our Service, you also agree to our Privacy Policy, which is incorporated into these Terms by reference.

Qiyam is an iOS mobile application designed to help Muslims review and retain their Quran memorization using scientifically-proven spaced repetition techniques, specifically the SM-2 algorithm.

Core Features

• Smart Quizzing: Context-aware verse quizzing that mimics natural memorization flow
• Adaptive Spaced Repetition: Personalized review schedules based on your performance using the SM-2 algorithm
• Workload Management: Intelligent scheduling to provide consistent, predictable daily reviews
• Progress Tracking: Detailed statistics and mastery levels for individual verses
• User Control: Fast-track verses, adjust mastery levels, and exclude frequently-recited surahs

Quranic Content Source

The Quranic text in the App is sourced from Al Quran Cloud API using the Hafs recitation. We strive for accuracy in presenting the Quranic text, but users should consult qualified scholars and authenticated printed Mushafs for religious guidance and verification.

Platform and Technical Requirements

• Platform: iOS only (available on the Apple App Store)
• Minimum iOS Version: [MINIMUM IOS VERSION REQUIRED]
• Internet Connectivity: Required for account creation, login, and automatic daily backups. Core memorization features work offline once logged in.
• Account Required: You must create an account to use the App

Service Availability

We strive to provide reliable, uninterrupted access to the App, but we do not guarantee that the Service will always be available, error-free, or free from interruptions. We reserve the right to:

• Modify, improve, or discontinue features at any time
• Perform scheduled or emergency maintenance
• Update the App to improve functionality and user experience

We will make reasonable efforts to notify users of significant changes, but we are not obligated to maintain any particular feature or functionality.

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the App, servers, or databases
• Interfere with, disrupt, or impose an unreasonable load on the App or servers
• Use the App for any commercial purpose without our prior written consent
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Use any automated system (bots, scrapers, scripts) to access the App without our permission
• Remove, obscure, or alter any copyright, trademark, or proprietary notices
• Use the App to transmit malware, viruses, or any harmful code
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with anyone

Account Security

You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

Our Intellectual Property

The Qiyam App, including its original content, features, functionality, source code, design, user interface, graphics, logos, and branding, is owned by Amine Benlaroui and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

"Qiyam" and the Qiyam logo are trademarks of Amine Benlaroui. You may not use these trademarks without our prior written permission.

Quranic Text

The Quranic text presented in the App is sourced from Al Quran Cloud API. The Quran itself is the sacred word of Allah (God) and is not subject to copyright. However, the specific digital compilation, formatting, and API provided by Al Quran Cloud are subject to their terms of use.

We acknowledge and attribute the Quranic text to Al Quran Cloud. Users are encouraged to visit alquran.cloud for more information about their Quranic text service.

License Grant to You

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Download and install the App on your personal iOS device(s)
• Access and use the App for your personal, non-commercial use
• Access the Quranic text solely through the App interface

This license does not grant you any rights to:

• Reproduce, distribute, publicly display, or create derivative works of the App
• Sell, rent, lease, or sublicense the App
• Remove or modify any proprietary notices or labels
• Use the App for commercial purposes

This license automatically terminates if you violate these Terms or if you delete your account.

Your Content and Data

Your memorization data, progress records, quiz results, and user-generated settings ("Your Data") remain your property. By using the App, you grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you.

We do not claim ownership of Your Data. You may request to export or delete Your Data at any time by contacting us at contact@qiyamapp.com.

Free Download and Trial

Qiyam is free to download from the Apple App Store. Upon creating an account, you will receive a 1-month free trial to access all features of the App.

Subscription Required After Trial

After your free trial ends, you must subscribe to continue using the App. We offer the following subscription options:

• Monthly Subscription: [MONTHLY SUBSCRIPTION PRICE] per month
• Annual Subscription: [ANNUAL SUBSCRIPTION PRICE] per year

Billing and Payment Processing

All payments are processed through Apple In-App Purchase. Your subscription will be charged to your Apple ID account upon confirmation of purchase.

• Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period
• Free Trial Conversion: If you do not cancel before your free trial ends, you will automatically be charged for your chosen subscription
• Trial Eligibility: The free trial is available once per user/Apple ID

Managing Your Subscription

You can manage and cancel your subscription at any time through your Apple ID account settings:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select Qiyam from the list
5. Tap "Cancel Subscription"

If you cancel your subscription, you will retain access to premium features until the end of your current billing period. No partial refunds are provided for unused time within a billing period.

Refund Policy

All subscription purchases are subject to Apple's standard refund policy. We do not directly process payments or issue refunds.

To request a refund, you must contact Apple Support directly through:

• The Apple Support website or app
• Your purchase history in the App Store
• reportaproblem.apple.com

Apple determines refund eligibility based on their policies. We cannot guarantee that Apple will approve your refund request.

Price Changes

We reserve the right to change our subscription prices at any time. Price changes will be communicated to you at least 30 days before they take effect.

• For New Subscribers: New prices apply immediately upon announcement
• For Existing Subscribers: Price changes apply at your next renewal after the notice period
• You may cancel your subscription before the new price takes effect if you do not agree to the price increase

Apple Terms Apply

All purchases are subject to Apple's Licensed Application End User License Agreement (EULA) and App Store terms. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to payment processing and subscription management.

No Warranty

The App is provided on an "AS IS" and "AS AVAILABLE" basis, with all faults. To the maximum extent permitted by applicable law, we make no warranties, expressed or implied, regarding:

• Accuracy: The accuracy, reliability, completeness, or timeliness of any content, including Quranic text sourced from Al Quran Cloud API
• Availability: The availability, accessibility, or uninterrupted operation of the App or its features
• Fitness for Purpose: That the App will meet your specific requirements or expectations
• Error-Free Operation: That the App will be free from bugs, errors, viruses, or other harmful components
• Internet Connectivity: The reliability of internet connectivity for backups and account synchronization
• Device Compatibility: Compatibility with all iOS devices or versions
• Data Preservation: That your data will never be lost, though we make reasonable efforts to backup your data

Religious Disclaimer

Important: Qiyam is a technology tool for personal Quran memorization and is not a religious authority, Islamic institution, or substitute for qualified Islamic scholarship.

• While we strive for accuracy in presenting the Quranic text, users should always verify with authenticated printed Mushafs and consult qualified Islamic scholars
• The App is a memorization aid only and does not provide religious instruction, interpretation (tafsir), or spiritual guidance
• We are not responsible for any religious rulings, interpretations, or decisions made based on use of the App
• The spaced repetition algorithm is a scientific learning tool and is not based on any particular Islamic methodology or school of thought

Third-Party Services

The App relies on third-party services (Al Quran Cloud API, Supabase, Apple services). We are not responsible for:

• Interruptions, errors, or changes in third-party services
• Third-party privacy practices or data handling
• The accuracy of data provided by third-party services

Disclaimer of Warranties

We disclaim all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. You may have other legal rights that vary by jurisdiction.

Exclusion of Damages

To the maximum extent permitted by applicable law, in no event shall Amine Benlaroui, Qiyam, or our affiliates, officers, employees, agents, partners, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data, including memorization progress or user content
• Loss of goodwill or reputation
• Cost of substitute services or technology
• Interruption of work or business
• Religious, spiritual, or personal harm

This exclusion applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we were advised of the possibility of such damages.

Liability Cap

Our total liability to you for all claims arising from or related to these Terms or your use of the App shall not exceed the greater of:

• The total amount you paid to us (through Apple In-App Purchase) in the 12 months immediately preceding the event giving rise to liability, or
• CHF 100 (one hundred Swiss Francs)

Specific Limitations

We are specifically not liable for:

• Data Loss: Loss of memorization data, though we make reasonable efforts to provide automatic backups
• Subscription Charges: Subscription billing issues, which are controlled entirely by Apple
• Third-Party Services: Failures, errors, or data breaches by Al Quran Cloud API, Supabase, Apple, or other third-party providers
• Unauthorized Access: Unauthorized access to your account resulting from your failure to protect your credentials
• Device Issues: Device malfunction, incompatibility, or data loss on your iOS device

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Swiss law.

Allocation of Risk

You acknowledge that the limitations of liability in this section are a fundamental element of the basis of the bargain between you and us. We would not be able to provide the Service on an economically reasonable basis without these limitations.

Termination by You

You may terminate your account and stop using the App at any time by:

• Canceling your subscription through your Apple ID settings (see Subscription section)
• Requesting account deletion by emailing contact@qiyamapp.com with "Delete My Account" in the subject line
• Deleting the App from your device

If you delete your account, you will lose access to all your memorization data and progress. We recommend exporting your data before deletion if you wish to keep a copy.

Termination by Us

We reserve the right to terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms of Service
• Violation of applicable laws or regulations
• Fraudulent, abusive, or illegal activity
• Failure to pay subscription fees (if applicable)
• Unauthorized access or security violations
• Prolonged inactivity (we will provide notice before terminating for inactivity)
• At our sole discretion to protect our business interests or other users

Effect of Termination

Upon termination of your account (by you or by us):

• Immediate Access Loss: Your right to access and use the App will immediately cease
• Data Retention: Your data will be retained for 30 days and then permanently deleted, as described in our Privacy Policy
• Subscription Status: Active subscriptions are managed by Apple. Termination of your account does not automatically cancel your subscription or entitle you to a refund
• No Refunds: We do not provide refunds for unused subscription time if your account is terminated for Terms violations
• Data Export: You may request a data export before account deletion by contacting us

Survival of Terms

The following sections shall survive termination of these Terms and continue to apply: Intellectual Property, Disclaimers, Limitation of Liability, Governing Law, and any other provisions that by their nature should survive.

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Changes may be made to:

• Reflect changes in our Service or business practices
• Comply with legal or regulatory requirements
• Improve clarity or address ambiguities
• Add new features or remove deprecated features

How We Notify You of Changes

Material Changes:

For significant changes that materially affect your rights or obligations, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you via email (to the email address on file)
• Display a prominent notice in the App

Minor Changes:

For minor updates (e.g., clarifications, typo corrections, formatting improvements), we will:

• Update the "Last Updated" date
• Post the revised Terms immediately without advance notice

Your Acceptance of Changes

By continuing to access or use the App after the revised Terms become effective, you agree to be bound by the updated Terms. If you do not agree to the new Terms, you must stop using the App and may delete your account.

Your Responsibility

It is your responsibility to review these Terms periodically for changes. We recommend checking the "Last Updated" date each time you use the App to see if the Terms have been revised.
